    That's a great point. I have a collision place I know that'll do a great inspection. I'm not fucking with a bent frame on a 2020 with 12k miles.

    No airbag deployment so very possible, but I’d bet my money on totaled. Mine had less damage and it was $15k

    Assuming the other driver's insurance company is covering the repair cost, you shouldn't need aftermarket parts coverage as that is on your policy, not his. Make their insurance company reimburse you for replacement value of all the accessories. Provide receipts. Depending on your insurance company, sometimes you can engage your agent to help advocate for you in these discussions as he/she knows the industry and has a vested interest in helping make sure you are made whole.

    A stock 2020 ORP with ~12k has a current retail of ~$49k, the current rule of thumb in todays market is the vehicle would be listed as totaled if the repair cost comes in at over 80% of the retail, or ~ $39k. I just went through this with my daughter's car. I wanted the car totaled but Progressive told me they wanted it repaired. The repair cost came in at 68.75% (3 quotes) of the retail value so I was forced to have the car repaired. It suck's as now I have a car that's reduced in value. I wish you all the best in getting the best outcome.

    Please tell me you had a dashcam. If that invertebrate pinky toe sucker lies to his insurance, then you will need to pay your deductible and wait for them to subrogate the guy. Dashcam video is the only way to hedge against a liar.

    If he does admit fault then as already mentioned you wont need to worry about aftermarket coverage because they are paying.

    Oh and most importantly im glad you are ok. Pain or worse from an accident is terrible.

    OP, you may be well aware of the following, but I went through a non-fault totaled car in CA recently:

    1. IF they total it, you can and should fight tooth and nail with the insurance company over their assessed value. It is a battle, but worth it in most cases. The initial offer on my last S8 was $43k. I got them up to $56k (which was fair) by the time I was done with them. I did not have to hire an independent appraiser, but it almost got to that. They also need to reimburse you for the CA upfront tax on the final assessed value, plus a portion of registration (they will do this automatically, but always best to double check that they did, so as to not confuse their actual offer with a worse offer plus tax etc, if that makes sense).
    2. Even if you do not have rental car coverage, it is CA insurance law that his insurance company reimburse you for a rental, and the best part is, you do not even have to rent a car if you have another available. They will cut you a check. This scenario only happens if the car gets fixed.
    3. IF they do fix it, you can file a "Diminishment of Value" claim against the insurance company. They will deny they even have a form for "such things", but they do. The formula they use is not really negotiable, but in your case I would guess you would get a check for $2-3k.
